BOOKEZ TERMS AND CONDITIONS

1. Introduction

1.1 These Terms and Conditions (“Terms”) constitute a legally binding agreement between BookEZ (hereinafter referred to as “BookEZ”, “we”, “our”, “us”) and any individual or entity using or accessing the BookEZ website, mobile application, or any associated services (collectively, the “Platform”).

1.2 By accessing, browsing, or using the Platform, you (“Guest”, “User”, “Customer”, “you”, “your”) acknowledge that you have read, understood, and agree to be bound by these Terms.

1.3 If you do not accept these Terms in full, you are not authorized to use the Platform and must immediately discontinue use.


2. Scope of Services

2.1 BookEZ provides an intermediary online booking service, enabling Guests to search for, compare, and reserve accommodation offered by third-party hotels, resorts, villas, and similar establishments (each a “Hotel” or “Accommodation”).

2.2 BookEZ does not own, manage, operate, or control Hotels. We act solely as an intermediary, transmitting reservations and facilitating payments between Guests and Hotels.

2.3 The Platform displays information (rates, descriptions, availability, photographs, amenities) provided directly by Hotels. While we exercise care in displaying this information, BookEZ does not guarantee its accuracy, completeness, reliability, or timeliness.


3. Use of the Platform

3.1 The Platform is intended solely for individuals aged 18 years or older. By using the Platform, you confirm that you are legally capable of entering into binding contracts.

3.2 You may use the Platform only for legitimate reservations You agree not to use the Platform for:

(a) speculative, false, or fraudulent bookings;

(b) resale of bookings without written consent;

(c) activities that may damage, impair, or disrupt the Platform;

(d) unlawful or unauthorized purposes.

3.3 BookEZ reserves the right to suspend or terminate your access if misuse or breach of these Terms is detected.


4. Booking Process

4.1 By completing a booking on the Platform, you enter into a direct, legally binding contractual relationship with the Hotel.

4.2 BookEZ acts solely as an intermediary and agent for the Hotel. Upon booking, we transmit your details to the Hotel and send you a Reservation Confirmation via email or the Platform.

4.3 Your Reservation Confirmation will specify:

(a) Hotel name and contact details

(b) Room type, number of guests, and dates of stay

(c) Total price, taxes, and fees

(d) Cancellation, modification, and refund terms

4.4 The Hotel remains solely responsible for honoring your booking and providing the accommodation. BookEZ has no liability for the Hotel’s acts, omissions, services, or failures.


5. Prices, Taxes, and Fees

5.1 Prices displayed on the Platform are set by Hotels. BookEZ is not responsible for errors, changes, or discrepancies in rates.

5.2 Prices are generally displayed in Sri Lankan Rupees (LKR) unless otherwise indicated. Foreign currency conversions are approximate and subject to fluctuation.

5.3 Prices may or may not include applicable taxes, levies, service charges, or additional fees (e.g., resort fees, city taxes). The Hotel is solely responsible for charging and collecting these amounts.


6. Payments

6.1 Payments for bookings are processed securely through Stripe, our third-party payment provider.

    • 6.2 Depending on the Hotel’s policy, you may be charged:
      • (a) immediately upon booking (prepayment), or (b) at a later date (pay later), or

(c) directly at the Hotel.

6.3 By making a payment, you authorize BookEZ to collect the amount on behalf of the Hotel.

6.4 BookEZ shall not be liable for any fees imposed by your bank, card issuer, or payment provider, including foreign transaction fees, chargeback costs, or currency conversion charges.

6.5 In the event of fraud, unauthorized transactions, or payment disputes, you must raise the issue with Stripe and your payment provider.

7. Cancellations, Modifications, and Refunds

7.1 Each Hotel sets its own cancellation, modification, and refund policies, which are displayed during the booking process and confirmed in your Reservation Confirmation.

  • 7.2 If a booking is non-refundable, no refund shall be issued under any circumstances, except where required by mandatory consumer law.

  • 7.3 For refundable bookings, refunds will be processed via Stripe back to the original payment method. Processing times vary by bank but may take up to 15 business days.

  • 7.4 BookEZ has no control over Hotel-imposed penalties, fees, or conditions for cancellations and modifications.

8. Liability

  • 8.1 BookEZ is not a party to the accommodation contract between Guest and Hotel. The Hotel is solely responsible for:

    • (a) accommodation quality and availability,
    • (b) safety and security of guests,
    • (c) compliance with applicable laws and regulations,
    • (d) accuracy of information displayed on the Platform.
  • 8.2 To the maximum extent permitted by law, BookEZ disclaims liability for:
    • personal injury, illness, or death;
    • property damage, theft, or loss;
    • indirect, incidental, or consequential damages;
    • service interruptions or errors on the Platform;
    • force majeure events beyond our reasonable control.
  • 8.3 BookEZ’s total aggregate liability under these Terms shall not exceed the total booking value paid through the Platform for the relevant reservation.

9. Indemnification

  • You agree to indemnify and hold harmless BookEZ, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, costs, or expenses (including legal fees) arising out of:

    • your breach of these Terms,
    • your misuse of the Platform,
    • your stay at a Hotel,
    • your violation of applicable laws or third-party rights.

10. Intellectual Property

  • 10.1 All intellectual property on the Platform (text, images, logos, software, trademarks) is owned by BookEZ or licensed to us.

  • 10.2 You may not copy, distribute, modify, or exploit content without our prior written consent.

11. Governing Law and Jurisdiction

  • 11.1 These Terms shall be governed by the laws of Sri Lanka.

  • 11.2 Any dispute arising from or related to these Terms, bookings, or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

  • 11.3 Where applicable, BookEZ may require disputes to be resolved through arbitration or mediation prior to court proceedings.

12. Miscellaneous

  • 12.1 Force Majeure – Neither BookEZ nor the Hotel shall be liable for failures caused by events beyond reasonable control, including natural disasters, government actions, strikes, or system outages.

  • 12.2 Severability – If any provision is held invalid, the remaining provisions shall remain in full effect.

  • 12.3 Entire Agreement – These Terms, together with any referenced policies (including Privacy Policy, Secure Payment Policy), constitute the entire agreement between you and BookEZ.

  • 12.4 Amendments – BookEZ reserves the right to amend these Terms at any time. Changes will be effective upon posting to the Platform. Continued use of the Platform after such changes constitutes acceptance.
